Registered Trademark:
1. Applicant Information Materials
(1) Individual Application:Provide a copy of personal ID card or passport, indicating name, address, and contact information.
(2) Company Application:Provide a copy of the company's business license or registration certificate, including the company name, address, legal representative's name, and other details.
2. Trademark Sample Materials:
Provide a clear trademark sample, preferably in JPEG or PDF format, which should clearly display the details of the trademark. If it is a three-dimensional trademark, sound trademark, or other special types, corresponding special instructions and materials reflecting its characteristics must also be provided. For color trademarks, it is recommended to provide a black and white version of the sample as well.
3. Goods/Services List Materials:
According to the Indian trademark classification standards (basically referring to international classification), list in detail the categories and specific items of goods or services designated for use by the trademark. This helps clarify the scope of trademark protection.
4. Power of Attorney Materials (if there is a delegated agent):
Provide a power of attorney signed by the applicant, authorizing the trademark agency to handle registration matters. The power of attorney needs to be notarized by an Indian notary or certified by an Indian consulate to ensure its legal validity in India.
5. Evidence of Use Materials (if applicable):
If the trademark has been used, according to Indian trademark law requirements, the applicant can provide evidence of actual use of the trademark, such as product packaging, advertising materials, sales invoices, contracts, etc., to prove the trademark's usage in the market. This is particularly important for trademark applications based on prior use principles or in response to potential objections.
6. Priority Documents (if claiming priority):
If the applicant wishes to claim priority based on the date of the first application in another country/region, they need to provide proof of priority documents. This includes the date of the first application, country/region, application number, etc., and the document needs to be notarized by an Indian notary or certified by an Indian consulate and translated (if not in English).
Registering a Company:
1. Shareholder Related Materials
(1) Identification Proof:Individual shareholders need to provide a passport or ID card and undergo dual certification by the Indian consulate; company shareholders need to provide a copy of the business license or registration certificate and proof of the company's authorized representative, all of which must be notarized.
(2) Address Proof:Individual shareholders can provide utility bills, bank statements, etc.; company shareholders need to provide proof of the company's registered address.
(3) Shareholding Distribution Documents:The shareholding ratio of each shareholder must be clearly defined, providing written explanations or board resolutions and other documents.
2. Director Related Materials
(1) Identification Proof:Indian directors need to provide PAN card and passport, etc.; foreign directors need to provide a passport and undergo notarization or Hague certification. If the passport does not have a date of birth, a certified proof of date of birth must be attached.
(2) Address Proof:Such as utility bills, bank statements, etc., must be valid documents issued within 2 months.
(3) Appointment Documents:Formal director appointment documents are required.
3. Company Registered Address Materials
Address Proof:If it is a leased address, a lease contract and a no-objection certificate issued by the landlord must be provided; if it is owned property, proof of property ownership must be provided.
4. Company Articles of Association Materials:
Company Articles Text:Draft the Memorandum of Association (MOA) and Articles of Association (AOA), including the company's purpose, business scope, shareholder rights and obligations, company governance structure, etc.
5. Registered Capital Related Materials
Registered Capital Amount Explanation:Clearly state the amount of the company's registered capital, with a minimum registered capital of 100,000 rupees, which can be subscribed, and explain the capital structure and the shareholders' contribution methods.
6. Other Materials
(1) DSC and DIN Application Materials:Prepare the application materials for the Director Digital Signature Certificate (DSC) and Director Identification Number (DIN) as required.
(2) Company Registration Application Form:Fill out and submit the company registration application form online, including basic information such as company name, registered address, shareholder and director information.
(3) Statutory Declaration Documents:Statutory declaration documents signed by the company's directors or authorized representatives, ensuring that the information provided is true, accurate, and complete.
