Product Description

Materials required for trademark registration
1. Registering a trademark as an individual:
(1) Color scanned copy of passport
(2) Chinese address (Indonesian address)
(3) Trademark name or pattern, and the types of goods or services used.
2. Registering a trademark as an Indonesian company:
(1) Scanned copy of the company articles of association
(2) Scanned copy of the Ministry of Justice approval (if there are changes)
(3) Scanned copy of the company tax card
(4) Scanned copy of the company domicile certificate
(5) Scanned copy of the chairman's ID card or passport and tax card
(6) Indonesian address
(7) Trademark name or pattern, and the types of goods or services used.
3. Registering a trademark as a foreign company:
(1) Notarized scanned copy of the company articles of association
(2) Notarized scanned copy of the company business license
(3) Scanned copies of the chairman's ID card and passport
(4) Foreign address
(5) Trademark name or pattern, and the types of goods or services used.

 

Trademark registration process
1. Trademark search, 1 working day
Before submitting the application, search for the applied trademark. If it can be confirmed that there are no similar or identical trademarks that are currently applied for or registered in Indonesia, then start the trademark registration process in Indonesia.

2. Submit application, 3-5 working days
Submit the trademark application to the Indonesian Intellectual Property Office (hereinafter referred to as "DGIP"); conduct trademark application, examination, and authorization.

3. Formal examination, 15-20 working days
After the application is submitted, a legality review of the submitted application documents, trademark samples, power of attorney, and other documents will be conducted; if compliant, the application date and application number will be granted; a notice of acceptance will be obtained, and the trademark can be used but marked as TM.

4. Substantive examination, about 12 months
Examine whether the trademark is registrable according to the law, whether it is identical or similar to previously registered trademarks, and whether it violates the prohibitive clauses of trademark law. For trademarks that do not pass the substantive examination,the examiner will notify the applicant in writing and inform the reasons for rejection.The applicant may submit a review within the time limit from the date of receiving the rejection notice (appeal fees will be notified separately). Otherwise, the application will be deemed abandoned, and both the application date and application number will not be retained. The applicant may apply for an extension if the extension fee is paid. The trademark examiner may conditionally accept certain trademark registration applications and may require the applicant to abandon the use rights of certain words or graphics in the trademark.

5. Trademark announcement, announcement period of 3 months
After the trademark passes the examination, the applicant will be informed that the trademark application has been accepted and published in the trademark announcement. Anyone can raise objections during the 3-month announcement period (the objection period can be extended for 3 months) and state reasons and submit relevant evidence.

6. Registration approval; obtain trademark certificate
Trademarks that are ruled to be registrable after objections or trademarks that have no objections after announcement will be approved for registration and a registration certificate will be issued.

Note: The entire smooth application process (if there are no rejections, objections, etc.) takes about 15-24 months.
